ASICS Ladies Pickleball Special

General Terms and Conditions

1. The ASICS Ladies Pickleball Special (“ALP”) event is held by ASICS MALAYSIA SDN BHD (the “Owner” or “ASICS”), organised by Linkedup Asia Sdn. Bhd., (the “Organiser”) in accordance with these Rules & Regulations (the “R&Rs”), applicable to all the participants (each a “Participant” or “you”, collectively the “Participants”), which can be found at https://linkedup.asia/pickleball/asicsladies/T&CASICSLadies.htm operated by Organiser (the “Official Website ”).” The terms of this R&Rs shall be between the Owner and a Participant.

2. By accessing and continuing to access any part of the Official Website, including to register for the ALP event as a Participant, submit information to ASICS, the Organiser and/or the relevant business partners, whether for the purpose of registering for ALP or otherwise, as well as using any features of the Official Website, you signify that you have read, understood and agree to the terms of this R&Rs.

3. Completion of the online Google form for registration, which can be found on the Official Website, confirms the Participant’s agreement and acceptance to abide by these R&Rs. Only an individual whose registration is successfully confirmed through the Official Website will be regarded as a Participant.

4. A Participant is prohibited from registering on behalf of anyone other than themselves and their nominated playing partner. In the event an individual is found to be participating using the name or Identification Card Number of another Participant, he or she shall be disqualified from the AP.

5. Registration for ALP is only confirmed upon issuance of an acknowledgement email by the Organiser.

6. ASICS and/or the Organiser will not be responsible in any way for any delay or inability in registration due to a connection problem from the Internet, computer, laptop, tablet, mobile phone or any other device used by the Participants for registration.

7. Once registration is confirmed, a Participant is strictly NOT ALLOWED to participate under another person’s name or number.

8. ASICS reserves the sole right to modify or substitute any of these R&Rs from time to time as they deem fit. The Participants will be notified of such changes by ASICS. If there is ambiguity in any of these provisions, ASICS shall be the sole authority to interpret them and in so doing, it may take into account the interests of all affected Participants. Any amendments to these R&Rs will also be updated on the Official Website at ASICS’ sole discretion.

9. ASICS reserves the sole right to delay, postpone, cancel or change any details of the ALP or any component of it at any time with prior notice to the Participants. In such cases, every reasonable effort will be made to inform the Participants prior to the day / date of the ALP. ASICS shall not be liable for any consequential loss or inconvenience caused due to any delay, cancellation or changes in any details of the ALP event or any component.

10. ASICS and/or the Organiser reserves the right to amend any components and rules of the ALP as they deem fit for the safety of the Participants and/or to prevent any potential hazards in the running of ALP, at any time without prior notice to the Participants. In such cases, every reasonable effort will be made to inform the Participants prior to the day / date of the ALP and ASICS shall not be liable for any consequential loss or inconvenience caused.

11. ASICS, its affiliated companies, its officers, agents, its related parties, and its representatives shall not be held liable for any losses, liabilities, costs, damages and/or expenses resulting from or arising out of the errors, omissions, faults, unreliability, inaccuracy of Official Website or Organiser’s registration form. ASICS does not warrant that the Official Website or Organiser’s registration form is accurate, secure, timely, uninterrupted or error free.

Eligibility

1. Participants can register for the ALP through the Official Website via a Google form provided at https://onthreesixty.com/focusfeature/asics-ladies-pickleball-special-2025/ and will have to pay the following registration fee in order to participate:

*All dates are subject to change at the sole discretion of ASICS and the Organiser.

2. The registration cut-off date will be whichever comes first of either the date 19^th May 2025 5.00pm Malaysia time or when all spots in each category are filled and a waiting list of 10 extra teams for each category is reached

3. Participants will be able to select multiple categories, however it is player's responsibility to not enter for categories that overlap. All categories require that all players have a DUPR ID and a verified DUPR rating of 3.99 or lower and a reliability of 70% or higher

4. Participants can only join the tournament by filling up required details in the Player fields found in the registration form located on the Official Website.

5. All Participants must be:

(i) at least nineteen (19) years of age and;

(ii) a Malaysian citizen or Malaysian resident permit holder

6. In the event that any Participant has successfully registered in a specific category and is later found to be ineligible for that category, ASICS or the Organiser shall have the right to disqualify the Participant and his/her team from the ALP and any registration fees paid by the Participants will not be refunded.

Personal Data Protection

1. For the purposes of this R&Rs, “personal data” means data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which the organisation has or is likely to have access.

2. When registering for the ALP event, a Participant will provide us with his or her personal data. During such registration, the Participant agrees to: (i) provide true, accurate, current and complete personal data about himself/herself in the registration form and (ii) maintain and promptly update ASICS and/or the Organiser (as the case may be) of the personal data provided by him/her to ensure it stays true, accurate, current and complete. ASICS and/or the Organiser may contact the Participant from time to time by email and/or SMS for the purpose of the ALP event. Any notice sent to the email address and/or SMS sent to the telephone number registered for the ALP via the registration form shall be deemed as received by the Participant.

3. If a Participant provides any information that is untrue, inaccurate, not current or incomplete or the Organiser has any ground to suspect that such information is untrue, inaccurate, not current or incomplete, the Organiser may suspend or terminate the Participant’s registration at its/their sole discretion.

4. By completing the registration for the ALP, a Participant hereby consents to ASICS’s, the Organiser’s and/or the relevant business partners’ collecting, using and/or disclosing your personal data for the following purposes: -

a. to facilitate the Participant’s registration for the ALP, including to verify the Participant’s identity;

b. to provide the Participant with information on the ALP, including key information such as tournament details and/or updates to the ALP;

c. to manage the administrative and business operations of ASICS, the Organisers, and other relevant business partners;

d. to conduct and manage the ALP, including for matters relating to promotional and the marketing of the ALP; and

e. for any other purposes as set out in ASICS privacy policy which can be found in paragraph 7 below.

5. Photographs, videos, motion pictures, images, recordings and other forms of recordings (collectively, “Recordings”) may be taken during the ALP, and hence a Participant may be captured in these Recordings. Such Recordings may be used for the purposes of marketing, advertising, and other promotional purposes related to the ALP (including to promote any further events which may be held after the ALP) by ASICS, the Organiser and/or the relevant business partners based on the legal bases and the exceptions to such legal bases under applicable data protection laws. However, ASICS, the Race Organiser and/or the relevant business partners shall not be responsible for any Recordings which are not taken by ASICS, the Race Organiser, and/or the relevant business partners during the ALP.

6. A Participant may withdraw his or her consent to the collection, use, and/or disclosure of his or her personal data by ASICS, the Organiser and/or the relevant business partners for the ALP. However, depending on the nature of such withdrawal, a withdrawal of consent could result in the inability of ASICS, the Organiser and/or the relevant business partners from allowing you to participate in the ALP. In all situations of a withdrawal, we will inform you of the legal consequences of such withdrawal. Safety

1. Whilst reasonable precaution will be taken to ensure the Participant’s safety, the Participant acknowledges and agrees that he or she will take part in the ALP at his/her own risk. To the greatest extent permitted by applicable law, ASICS and the Organiser shall not be held liable for any loss, damage to property, personal injury or death howsoever arising in connection with the ALP. Each Participant is strongly encouraged to consult his/her medical practitioner prior to the registration of the ALP and before the actual date of tournament.

2. A Participant shall be prohibited from participating in the ALP immediately if required to do so by any member official medical staff, event officials, referee and/or security officer belonging to the Organiser and/or other government agencies.

Waiver, Warranty and Indemnification

1. In consideration of ASICS and the Organiser allowing or accepting (without liability) the Participant to participate in any way in the ALP and/or activities registered through the Official Website, the Participant accepts and assumes all of the risks and dangers and any potential risks and dangers in connection with the Participant’s participation in the ALP.

2. Whilst reasonable precaution will be taken by ASICS and the Organiser to ensure the Participant’s safety, the Participant acknowledges and agrees that he/she takes part in the Activity as a participant at his/her own risk. The Participant (including his/her heirs, successors and assigns) hereby agree to hold ASICS, the Organiser or their respective officers, representatives, affiliates, employees and/or agents (each an 'Indemnified Party') harmless and keep each Indemnified Party fully and effectively indemnified from and against any and all losses, costs (including legal costs on a full indemnity basis), claims, damage and expenses whatsoever which any of them may incur (directly or indirectly) for the Participant’s personal injury or death arising from the Participant’s participation in the ALP or for any loss of or damage to the Participant’s property arising from the Participant’s participation in the ALP, except for such injury or death that is caused directly by ASICS’s and/or the Organiser’s gross negligence. The Participant fully and forever releases the Indemnified Parties from all and any liability of whatsoever nature and howsoever arising to the fullest extent permitted by applicable laws and waives and relinquishes the right to sue or take any action or proceeding against the Indemnified Parties (or any of them) for any and all claims, demands, losses or damages of the Participant on account of any injury, death, damage to property or any other cause of action, which is caused or alleged to be caused in whole or in part by the negligence, fault, act or omission of the Indemnified Parties (or any of them) or otherwise.

3. The decision of the Organiser and ASICS on all and any matter in connection with the ALP (including without limitation the awarding of prizes) shall be final and binding.

4. If any provision (or any part thereof) of these R&Rs or any terms and conditions of the ALP is held by a competent court or other competent authority in a final decision (namely, after exhausting all appeal avenues if applicable) to be illegal, void or unenforceable in the relevant jurisdiction, that provision or the relevant part thereof shall be deemed to be deleted and the remaining provisions shall continue in full force and effect in respect of such jurisdiction.

5. A failure or delay by the Organiser and/or ASICS in exercising, or in omitting to exercise, any right, remedy, power or privilege accruing to the Organiser and/or ASICS hereunder, or the knowledge or acquiescence by the Organiser and/or ASICS of or in any breach of any of these R&Rs, shall not impair or operate or be construed as a waiver of such right, remedy, power or privilege or an acquiescence in such breach or a waiver of such R&Rs any of them. No waiver shall be binding on the Organiser and/or ASICS unless it is made in writing. No waiver by the Organiser and/or ASICS of a breach of any R&Rs shall constitute a waiver of any subsequent breach of the same or any other R&Rs.

6. These R&Rs shall be binding on the heirs, personal representatives, executors and administrators and permitted assigns of the Participant.

7. By completing the registration on the Official Website for the ALP, the Participant hereby represents, warrants and undertakes to ASICS the following: -

a. The Participant does not have any medical condition that would affect his or her safety or physical well-being.

b. The Participant is medically and physically fit and competent to participate in the ALP; and

c. The Participant fully abides by these R&Rs stipulated herein and any applicable laws.

8. The Participant (including the heirs, successors and assigns) agrees to hold ASICS, the Organiser, Sponsors, appointed officials/suppliers (each an ‘Indemnified Party’) harmless and keep each Indemnified Party fully and effectively indemnified from and against any and all losses, costs (including legal costs on a full indemnity basis), claims, damage and expenses whatsoever which any of them may incur (directly or indirectly) as a result of the breach of the Participant of any of these R&Rs.

9. These R&Rs shall be governed under the laws of Malaysia and the Participant agrees to submit to the exclusive jurisdiction of the courts of Malaysia.

Tournament

1. Participants are to assemble at the designated venue, The Kitch’n Club. Unit 10A, Jalan Teknologi 3/4, Taman Sains Selangor, 47810, on 24^th May 2025 for registration at 7.30am prior to commencement of play at 8.00am Malaysia Time.[CL1]

2. For safety reasons, ASICS prohibits the following persons from participating in the event:
- expectant mothers unless the expectant mothers provide a medical certificate from a qualified gynaecologist (other than the expectant mother or her family member) and certify she is fit to participate in the ALP. The certificate should be dated within seven days of the ALP.

3. ASICS and the Organiser will not be held responsible for any loss and/or damage, personal or otherwise, to the belongings and items deposited at the event baggage storage facility. ASICS and/or the Organiser also reserves the right to open and examine any item or baggage deposited for security and safety purpose.

Winners & Prizes

1. The Prizes shall be as follows:

Doubles Cash Prize

1^st Prize – Cash Prize of RM1,000 only, 2 Pairs of ASICS shoes of ASICS’s choice

2^nd Prize – Cash Prize of RM800 only, 2 Pairs of ASICS shoes[CL2] of ASICS’s choice

3^rd Prize – Cash Prize of RM600 only, 2 Pairs of ASICS shoes[CL3] of ASICS’s choice

2. ASICS or the Organizer reserves the sole right to replace any winner if they are found to be disqualified.

3. All winners must report to the winner’s podium following the announcement of the prize giving which will be made over the PA system. The winners must be registered through the system provided by the Organizer and provide proof of identification to redeem the prize. All uncollected prizes after the event ends on 24^th May 2025 10pm Malaysia time will be forfeited.

4. A Participant who cannot provide valid proof of identification is subject to disqualification and may not redeem the prize.

5. The decision of the Committee which includes, amongst others, the Malaysia Pickleball Association, Organiser and ASICS will be final and conclusive.

Conduct of Participants

1. Participants shall not engage in the following conduct at all times during the course of registration and/or during the ALP:

a. Participating while unregistered either in full or in part, swapping teams or forging identification.

b. Ambush marketing activities.

c. Organised protests / demonstrations.

d. Political and/or vulgar dress code.

e. Disrespectful remarks and/or comments towards the Committee.

f. Any other conduct which might cause bad repute to ASICS and the Organiser or be disruptive to the ALP.

2. Any Participant found in breach shall be immediately disqualified and prohibited from participating in the ALP. If one Participant is disqualified from the ALP, his/her team member shall also not be allowed to participate in the ALP.

Results

1. All matches shall be officiated and decided by referees/tournament directors that have been officially trained by the Asia Federation of Pickleball (“AFP Referee”).

2. Winners will be announced at conclusion of placing matches and before the prize-giving ceremony.

3. The results of all categories will be verified by AFP Referee, ASICS and the Organiser and their decision is final and binding.

IMPORTANT NOTE:

Whilst every reasonable precaution will be taken by the Organiser to ensure the safety of Participants, Participants are strongly encouraged to go for a medical examination and/or consult their medical practitioner prior to registration and before the actual tournament day.
